LIMITED PRODUCT WARRANTY

Limited Warranty

Trunwell, Inc. ("Trunwell") warrants to the original retail purchaser ("Purchaser") that each Trunwell life safety detector sold by Trunwell (each a "Product" and collectively, the "Products") will be free from defects in materials and workmanship under normal residential use and service for a period of five (5) years from the date of the original retail purchase.

If, after inspection of the returned Product, Trunwell determines that the Product failed due to a defect in materials or workmanship covered by this Limited Warranty, Trunwell will, at its sole option, repair the Product or replace it with the same model or a comparable model of equal or greater functionality.

Replacement Products may be new or refurbished. Any repaired or replacement Product shall be warranted only for the remainder of the original warranty period or ninety (90) days from the date of shipment, whichever is longer. Repair or replacement of a Product does not restart, renew, or extend the original warranty period.

This Limited Warranty is non-transferable and applies only to the original retail purchaser.

Proof of the original purchase from an authorized Trunwell distributor or reseller is required to obtain warranty service.

Conditions of Warranty

This Limited Warranty applies only if the Product:

  • Was purchased from Trunwell or an authorized distributor or reseller.

  • Was installed, tested, operated, and maintained in accordance with the Product Installation Manual and all applicable federal, state, provincial, and local laws, regulations, building codes, fire codes, and any standards referenced in the Product instructions.

  • Was used only for its intended residential application unless otherwise specifically approved by Trunwell.

  • Has not been subjected to misuse, abuse, neglect, accident, unauthorized relocation, or improper installation.

Factory-Sealed Product - No User-Serviceable Parts

IMPORTANT: THIS PRODUCT IS A FACTORY-SEALED LIFE SAFETY DEVICE. THERE ARE NO USER-SERVICEABLE PARTS INSIDE.

Each Product has been engineered, tested, and safety certified as a complete factory-assembled unit. The Product is designed to remain sealed throughout its service life and is not intended to be opened, disassembled, repaired, modified, serviced, recalibrated, or altered by the Purchaser or by any person not expressly authorized in writing by Trunwell.

Any unauthorized opening, disassembly, puncturing, cutting, alteration, modification, repair, replacement of internal components, removal of factory seals, bypassing of safety features, recalibration, or any other form of tampering with the Product constitutes misuse and shall void this Limited Warranty to the maximum extent permitted by applicable law.

Unauthorized modification or repair may impair the Product's performance, invalidate its applicable safety certifications, and prevent the Product from performing its intended life safety functions.

There are no field-serviceable or user-replaceable electronic components inside the Product. Trunwell does not authorize any distributor, installer, retailer, service company, or consumer to repair, modify, rebuild, recalibrate, or otherwise service any Product unless expressly authorized in writing by Trunwell.

If a Product appears to be defective, do not open or attempt to repair the unit. Contact Trunwell Customer Support for warranty assistance.

Warranty Exclusions

This Limited Warranty does not cover any Product damaged or rendered inoperative due to:

  • Improper installation, maintenance, inspection, testing, storage, transportation, or operation.

  • Failure to follow the Product instructions.

  • Abuse, misuse, negligence, accident, vandalism, or unauthorized relocation.

  • Fire, flood, water intrusion, excessive moisture, condensation, corrosion, chemicals, contamination, insects, rodents, or other environmental conditions beyond the Product specifications.

  • Lightning, electrical surges, improper voltage, electrical disturbances, or utility failures.

  • Acts of God, including hurricanes, tornadoes, earthquakes, floods, or other natural disasters.

  • Commercial, industrial, institutional, or any application for which the Product was not designed unless expressly approved by Trunwell.

  • Unauthorized opening, disassembly, modification, repair, recalibration, rebuilding, or tampering.

  • Removal, alteration, or damage to any factory seal, certification mark, serial number, manufacturing date code, or regulatory label.

  • Use of unauthorized replacement parts or accessories.

  • Failure to periodically test the Product in accordance with the Product instructions.

  • Continued use after the Product has reached the end of its stated service life or after it has failed any required functional test.

Replaceable batteries (if applicable) are consumable items and are not covered under this Limited Warranty unless otherwise expressly stated.

Service Life

Each Product has a stated service life identified on the Product label or in the accompanying documentation. The Product should be replaced upon expiration of its stated service life or immediately if it fails testing, indicates end-of-life, or otherwise no longer operates as intended.

Replacement of a Product at the end of its stated service life is considered normal maintenance and does not constitute a defect in materials or workmanship.

Important Life Safety Notice

The Products are designed to provide early warning of certain smoke, fire, carbon monoxide, and/or natural gas hazards, depending on the specific model, when properly installed, tested, maintained, and operated in accordance with the Product instructions.

No detector can guarantee detection of every fire, smoke condition, carbon monoxide event, natural gas leak, hazardous condition, injury, death, or property damage. Environmental conditions, installation location, maintenance, power interruptions, product limitations, and numerous other factors may affect performance.

This Limited Warranty covers only defects in materials and workmanship. It does not guarantee uninterrupted operation or detection of every hazardous condition.

The Products are not a substitute for homeowners insurance, renters insurance, life insurance, health insurance, disability insurance, property insurance, or any other form of insurance.

For maximum protection, Products should be installed, tested, maintained, and replaced at the end of their stated service life in accordance with the Product instructions and all applicable laws, regulations, and codes.

Disclaimer of Other Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS LIMITED WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY TRUNWELL.

TRUNWELL DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Where implied warranties cannot legally be disclaimed, they shall be limited to the duration of this Limited Warranty.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUNWELL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS, LOSS OF USE, LOSS OF DATA, PROPERTY DAMAGE, PERSONAL INJURY, WRONGFUL DEATH, OR ANY OTHER LOSS ARISING OUT OF OR RELATED TO THE PURCHASE, INSTALLATION, OPERATION, MISUSE, FAILURE, OR INABILITY TO USE A PRODUCT, WHETHER BASED ON CONTRACT, NEGLIGENCE, STRICT LIABILITY, TORT, OR OTHERWISE, EVEN IF TRUNWELL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

UNDER NO CIRCUMSTANCES SHALL TRUNWELL'S TOTAL LIABILITY EXCEED THE ORIGINAL PURCHASE PRICE PAID FOR THE APPLICABLE PRODUCT.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, these limitations shall apply only to the maximum extent permitted by applicable law.

Warranty Claims

To obtain warranty service, the Purchaser must:

  1. Contact Trunwell Customer Support within thirty (30) days after discovering the claimed defect.

  2. Provide proof of purchase from an authorized Trunwell seller.

  3. Provide a description of the issue.

  4. Obtain a Return Merchandise Authorization (RMA) before returning the Product.

Products returned without prior authorization may be refused.

The Purchaser is responsible for all costs associated with removal, reinstallation, labor, inspection, testing, and shipping the Product to Trunwell unless otherwise required by applicable law.

Trunwell will pay the cost of return shipping for repaired or replacement Products shipped to the Purchaser within the United States.

Governing Law

This Limited Warranty shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles, except where prohibited by applicable consumer protection laws.

If any provision of this Limited Warranty is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

This Limited Warranty gives the Purchaser specific legal rights. The Purchaser may also have other rights that vary by state, province, or country.
